This person can be challenged in court
Only the person in whose name the property is owned can donate his property. It is not possible that another person donates someone else's property.
Only that property can be donated which is not occupied by anyone. The next rule is that only the person whose name is registered in the ownership of the property can donate it.
Many times it is also seen that the person donating should be of healthy mind. That is, he should not be a victim of any mental instability or insanity. If such a person donates his property, it can be challenged in the court.
Mortgaged property cannot be donated
You have the right to donate only your own self-acquired property . A property which has any kind of restriction or ban on it or which is mortgaged cannot be donated. If you have inherited any property, you can gift it.
Which property can be donated
There is also a right to donate the inherited property, provided permission is taken from the legal heir or successor. Not only this, the property given as a gift can also be taken back.
There is a special rule for this. This is explained in Section 126 of the Property Transfer Act. Conditions will have to be added in the Gift Deed that if the purpose for which the gift is being given is not fulfilled, then the gift can be taken back.
Who can donate property
